Personal data

 

  1. In its capacity as the data controller, the company ANTELITIS SELARL, a law firm based at 28, rue du Maréchal Foch, 67000 STRASBOURG, represented by its Manager, Ms. LORENTZ, performs the processing of personal data and in this framework collects only personal data which is appropriate, relevant and strictly necessary to the end purposes for which ANTELITIS processes them.

  2. The legal basis for the processing of the personal data by the company ANTELITIS concerned is:

 

- The legitimate interest of the company ANTELITIS in pursuit of the following end purposes:

* Prospection, notably by sending information e-mails concerning ANTELITIS or legal news;

* Organisation of, registration for and invitations to the firm’s events;

* Implementation of the activity of the company ANTELITIS

In the two first cases, the legitimate interest of the company ANTELITIS is the client development.

In the third case, the legitimate interest of the company ANTELITIS is the implementation of an efficient internal organisation in order to exercise effectively its professional activity in compliance with its professional obligations.

 

- The performance of pre-contractual measures or the implementation of the contract when the company ANTELITIS performs processing with the following end purposes:

* The production, management and tracking of its clients’ cases and accounts;

* The collection of receivables.

 

- the compliance with legal and regulatory obligations when the company ANTELITIS performs processing with the following end purposes:

* The prevention of money-laundering and the financing of terrorism, and the fight against corruption;

* Invoicing;

* Accountancy.

 

  1. The company ANTELITIS performs the processing of following personal data categories :

- Civil, family and banking data;

- Identification number (social security number, tax identification number, SIREN or SIRET number, etc.);

- Contact data (mail adress, phone number, e-mail adress, etc.);

- Professional data (position, appointement);

- Pictures.

 

  1. The company ANTELITIS only stores the data for the length of time necessary to the operations for which they were collected and in compliance with the applicable regulations.

 

On this point, clients’ data are stored for the duration of the contractual relationship:

 

  • plus a period of 3 years for prospection purposes, without prejudice to storage-related obligations or limitation periods,

 

  • plus the period to storage-related obligations or limitation periods , , plus a further period of 6 months (in order to give to the company enough time to delete the personal data), ; the said storage-related obligations or limitation periods are notably the following:

    • Regarding the prevention of money laundering and the financing of terrorism, the data are stored for 5 years up to the end of the relationship with the company ANTELITIS.

    • For accountancy purposes, they are stored for 10 years up to the concerned financial year end.

 

In other cases, the personal data processed by the company ANTELITIS are stored for the time necessary to the attainment of the end purposes for which they are processed. Certain data may also be subject to special storage requirements when such storage is necessary to the company ANTELITIS in order to confirm, exercise or defend its rights in court (for example: a liability claim against the company ANTELITIS).

 

Prospects’ data are stored for 3 years up to the data collection or for 3 years upto the last contact of the prospect.

 

  1. The processed data are intended for authorised persons at the company ANTELITIS and external service providers whose assistance is necessary either to ensure the satisfactory operation of the Law Firm (accountants, IT technicians, insurers), or to the performance of the contract concluded with the client (postal services providers, court officers, etc.).

The data may also be communicated to third parties:

  • to meet legal, regulatory or professional obligations (for example: communication to the President of the Bar, to the CARPA - union for funds managing barristers' pecuniary settlements-);

  • -To perform the contract concluded with the client (for example: communication to opposing parties or to their attorneys, to the administration – for example: CFE – Business formalities centers, RCS – Commercial registers-, to the judiciaries – for example: courts, judicial experts-).

 

  1. The company ANTELITIS hereby specifies that all processed data are stored within the European Union.

  2. a.  In accordance with the in force regulations, the persons concerned by the processing implemented by the company ANTELITIS have following rights against the company ANTELITIS:

- a right to access to the data concerning them,

- a right to rectify them,

- a right to limit their processing,

- a right to delete them,

- a right to data portability.

b. Moreover, pursuant to the provisions of article 21 of the European data protection regulation, the persons concerned have:

  • the right to oppose the processing of personal data for which the legal basis is the legitimate interests of the Law Firm, at any time, for reasons related to their particular situation,

  • and the right to oppose the processing of personal data concerning them for prospection purposes.

    c. Furthermore, pursuant to the provisions of the French law no.78-17 of 6 January 1978 concerning information technology, computer files and personal liberty, the persons concerned also have:

  • the right to oppose the processing of personal data concerning them, on legitimate grounds,

  • and the right to define instructions concerning what is going on with their data after their death.

    d. The persons concerned have the right to submit a complaint to a regulatory authority (for example: the CNIL -the French data protection authority).

 

  1. Clients of the company ANTELITIS:

- undertake to inform their employees of the processing by the company ANTELITIS of their personal data as well as of their rights relating to this item,

- and undertake to communicate to the company ANTELITIS only personal data that has been collected and processed in compliance with the in force legal and regulatory provisions.

  

9. The persons concerned may exercise their rights at any time by contacting the company ANTELITIS either by e-mail at contact@antelitis.eu, or by letter, writing to ANTELITIS, 28, rue du Maréchal Foch, 67000 STRASBOURG, accompanied by a signed copy of an identity document.
